1. About these terms

These terms govern access to and use of the Actimise website. By continuing to use the website, you agree to use it in accordance with these terms.

These terms relate only to the website. Property-management, Tenant Find and other services are governed by separate written Terms of Business or service agreements provided before Actimise is formally instructed.

3. Using this website

You may use this website for lawful personal or business purposes, including reviewing Actimise services, reading landlord guidance and submitting a property or general enquiry.

You are responsible for ensuring that anyone who accesses the website through your internet connection is aware of these terms and complies with them.

You must provide accurate information when submitting an enquiry. Submitting a form does not create a client relationship, management agreement, tenancy or binding instruction.

4. Website information

Actimise takes reasonable care when preparing website content. However, property, tenancy and regulatory matters can depend on individual circumstances, and website information may not be complete or suitable for every property.

Website content may be reviewed, corrected, expanded or removed without prior notice.

Actimise does not promise that every page will always be current, complete or free from error.

5. Rental appraisals and property information

Any rental appraisal, fee illustration or service recommendation provided through or following a website enquiry is an initial assessment based on the information available at the time.

Rental values may be affected by market conditions, property condition, location, documentation, legal requirements and tenant demand.

An appraisal is not a guarantee of: the rent that will ultimately be achieved; the time required to secure a suitable tenant; continuous occupancy; tenant performance; future property value; or future rental-market conditions.

A final service proposal may require further property information, document checks or inspection.

6. No professional advice

Website content is provided for general information only. It is not legal, tax, financial, investment, mortgage, insurance, surveying or structural advice.

Landlords and other users should obtain appropriate professional advice where a decision depends on their individual legal, financial, tax or property position.

Nothing on this website should be treated as a substitute for reviewing the relevant legislation, official guidance, tenancy documents, lease, mortgage conditions, insurance terms or specialist advice.

7. Enquiries and service instructions

Submitting an enquiry does not oblige Actimise to accept an instruction and does not oblige the person making the enquiry to purchase a service.

Actimise may request further information before confirming whether a service is available or suitable.

No property-management, Tenant Find or related service begins until the required checks have been completed and the relevant written agreement has been accepted.

Displayed prices describe the current headline fees shown on the website. The scope, payment arrangements and any separately agreed or third-party costs will be confirmed before instruction.

8. Intellectual property

Unless stated otherwise, the website design, Actimise branding, written content, original graphics and downloadable resources are owned by or licensed to Actimise.

You may view, print or save reasonable extracts for personal reference or internal business use.

You must not, without prior written permission, reproduce substantial parts of the website; republish Actimise guides as your own work; remove ownership notices; sell or commercially distribute website content; use Actimise branding in a way that suggests an unauthorised association; or copy the website design or content to create a competing publication.

Third-party trademarks, photographs and other materials remain the property of their respective owners.

9. Acceptable use

You must use the website lawfully and in a manner that does not interfere with its availability, security or operation.

Reasonable browsing, sharing of public links and submission of genuine property enquiries are permitted.

10. Prohibited activity

You must not use the website for unlawful or fraudulent purposes; submit deliberately false, abusive or malicious enquiries; attempt to gain unauthorised access to the website or its administration systems; introduce viruses, malicious code or harmful material; interfere with security or form-protection systems; conduct automated activity that places an unreasonable load on the website; scrape or reproduce substantial website content without permission; impersonate another person or misrepresent your authority; use Actimise branding without permission; or attempt to obtain information that is not intended to be publicly available.

11. Website availability

Actimise does not guarantee that the website or every feature will always be available without interruption.

Access may be restricted temporarily for maintenance, security, technical work or circumstances outside Actimise’s reasonable control.

Where reasonably possible, Actimise will seek to restore affected services without unnecessary delay.

13. Security

Actimise takes reasonable steps to protect the website and enquiry process. However, no internet service can be guaranteed to be completely secure or free from harmful material.

You are responsible for protecting your own device, accounts and internet connection.

Do not send highly sensitive personal or financial information through a general website enquiry form unless Actimise has specifically provided a secure method for doing so.

14. Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to that limitation, Actimise is not responsible for loss arising solely from reliance on general website information without obtaining appropriate advice; inaccurate or incomplete information supplied by a website user; changes in market conditions; unavailability of a third-party website; events outside Actimise’s reasonable control; or unauthorised or unlawful use of the website.

These Website Terms do not alter any rights or responsibilities contained in a separate written service agreement.

15. Privacy and cookies

Personal information submitted through the website is handled in accordance with the Actimise Privacy Notice. Information about cookies, local storage and similar technologies is provided in the Cookie Policy.

16. Governing law

These Website Terms and any dispute relating solely to use of this website are governed by the laws of England and Wales.

The courts of England and Wales will generally have jurisdiction, subject to any mandatory consumer rights that apply.

17. Changes to these terms

Actimise may update these Website Terms to reflect changes to the website, business operations, technology or applicable requirements.

The latest version will be published on this page together with an updated review date.

Continued use of the website after an update is subject to the version then in effect.
